I agree with Sam, it should be the organization's prerogative, not anyone else's, unless your by-laws say otherwise. I'd check those to see what they say about hiring.

I don't see why not. Sure, you're a non-profit, but you're not a government agency or anything. You should be able to hire anyone you like without advertising the position first.
That said, I'm not a lawyer (nor do I play one on TV).
