It is quite rare for a person to be injured because of the condition of a bicycle. Perhaps they'll have to ride slower or stop. Riding in traffic or over rough surfaces can be dangerous no matter what condition the bike is in.

I'm not a lawyer, but I don't know of any case where a bike shop was successfully sued for damages from a bike accident.
